In July 2012, the NCAA Committee on Infractions (“Committee”) issued findings and found that Pepperdine University (“Pepperdine”) committed major violations of NCAA legislation. Pepperdine recently came back before the Committee because it failed to implement a penalty prescribed by the Committee following the first hearing that related to a grants-in-aid reduction in men’s volleyball. Because this matter directly relates to a failure to implement a penalty, the Committee considered it a supplemental proceeding and decision. After the June 2012 hearing, the Committee adopted, among other things, Pepperdine’s proposed penalty in men’s volleyball of a reduction of 1.13 grants-in-aid per year beginning with the 2011-12 academic year and concluding with the 2014-15 academic year. However, Pepperdine did not implement the reduction for these years and, in fact, did not do so for the 2011-12 academic year which immediately preceded the hearing held before the Committee. Pepperdine argued that it meant to implement the penalty by aggregating the penalties; however, Pepperdine never articulated such a desire or need to the Committee in the original hearing. The Committee concluded that Pepperdine neither implemented the prescribed penalty nor satisfied the terms of its probation.

As a result, the Committee extended Pepperdine’s probationary period by one-year; therefore, Pepperdine’s probation will expire on July 2, 2016.
