April 8, 2016Christian Dennie of Barlow Garsek & Simon, LLP recently received a successful result on behalf of a client on appeal. Christian was retained after the client was unsuccessful before a Tarrant County jury and was asked to argue before the Fort Worth Court of Appeals. The case was subsequently transferred to the Eastland Court of Appeals. Christian drafted the appellate brief and argued before the Eastland Court of Appeals arguing that the alleged real estate transaction was barred by the statute of frauds and that the plaintiff sued the wrong party. The Eastland Court of Appeals agreed and completely overturned the trial court’s judgment and ruled that the plaintiff take nothing. The case was then appealed to the Texas Supreme Court on a petition for review. The Texas Supreme Court required full briefing from the parties, but ultimately denied the petition for review and affirmed the Eastland Court of Appeals’ ruling.
