January 17, 2012West Virginia University (“WVU”) and the Big East Conference (“Big East”) are going to non-binding mediation per the order of the judge overseeing the case in Rhode Island. Mediation is common in nearly every case and gives the parties an opportunity to resolve the conflict prior to trial. In this case, the parties will likely mediate their dispute in total (i.e., both the case pending in West Virginia and the case pending in Rhode Island). A third-party will try to help the parties shed light on their positions in an effort to compromise the dispute. The parties will be back in court in Rhode Island on February 9th to update the judge on the status of the case.
